Consultant Type B: Finalization of TIPSOM (Trafficking in Persons and Smuggling of Migrants) Case Compendium

The objectives of this consultancy include

  • To develop a reference tool for judges and other legal practitioners who hear and conduct TIPSOM cases, in order to support prosecutorial efforts in addressing human trafficking and migrant smuggling;
  • To provide in one place all the key judgments on TIPSOM cases in Malaysia, as well as analyses or commentaries to contribute to the better understanding of cases, such as those that have or have not led to convictions.
  • To identify as additional reference other key landmark judgments from relevant jurisdictions, which may be persuasive in Malaysian courts to advance the conduct of TIPSOM cases in Malaysia.

IOM is seeking a qualified consultant to review the existing draft of TIPSOM case compendium, update and finalize it with the abovementioned objectives for judges and legal practitioners in Malaysia.

The assignment shall be conducted for a total period of approximately 25 working days over 2 months, indicatively from September 2026.

The selected consultant will complete the following deliverables

  • 1st deliverable: To build on the existing draft case compendium and conduct a comprehensive legal review and analysis of case laws in legal journals and other resources relating to TIP in Malaysia, as well as landmark judgments from relevant jurisdictions (FTE: max XX days)
  • 2nd deliverable: To present and submit the first revised case compendium, including analysis and commentary.
  • 3rd deliverable: To incorporate feedback from IOM and other stakeholders and submit the final draft compendium (FTE: max 25 days)

Performance indicators for the evaluation of results

The evaluation of results and corresponding payments will be based on the deliverables received and approved by IOM as detailed above.

Education, Experience and/or skills required

  • Possess at least a bachelor’s degree in law preferably and a minimum of 7 years of relevant professional experience in anti-trafficking and smuggling of migrant law.
  • Prior work experience in relation to migrant protection thematic areas in Malaysia is essential.
  • Demonstrated professional record in reviewing legal jurisprudence.
  • Equipped with good legal research, analytical, and drafting skills; ability to work independently.
  • Demonstrated work experience with IOM and/or the UN Agencies is an advantage.
  • Demonstrated ability to draw lessons from relevant national legal jurisprudence.
  • Excellent time management skills and ability to produce outputs as per agreed timelines.
  • Proficiency in Bahasa Melayu and English is required.

Interested candidates must submit the following

A detailed and up to date curriculum vitae;

  • Technical proposal (max. 5 pages) detailing the proposed approach, methodology, and a draft work plan for developing the materials, demonstrating an understanding of how to develop the Working Draft of the Case Compendium. The proposal must also include a financial proposal with a daily rate and total proposed cost for the assignment.
  • Two samples of previous work, specifically operational guidelines, manuals, or toolkits developed by the candidate.
